The Albanian Council of Ministers has defined new rules about the selling or the privatization of objects and land banks, owned by the state. The decision sets new criteria and procedures for the selling of lands of enterprises or objects that have been privatized before or constructed based on construction permits.
This regulation defines the necessary documentation that interested individuals must submit in order to be able to buy the above-mentioned state properties. Natural or legal persons have to submit a letter of application for purchasing a certain surface along with the mortgage certificate or the property card, for the object or the object the person owns, issued by the local office of the real estate registration, and the showing map of the real estate, updated no later than 15 days from the date of the submission of the application.
The interested person must also submit the notarized duplicate of the contract of sale of the facility or the enterprise, issued by the National Agency of Privatisation, former Central Agency of Restructuring and Privatization of Agricultural Enterprises or the contract issued by relevant enterprises before the establishment of the above-mentioned agencies. The interested person must also submit the notarized Xerox of the facility’s master-plan or that of the enterprise (in the moment of privatization). Interested persons must submit even the notarized copy of the construction permit and that of the purchase contract.
After the finalization of the application, Department of Public Property Management of the Ministry of Finances, after receiving the useful documentation from the local government authorities, Property Restitution and Compensation Agency, the local office of the real estate registration, regional directories of agriculture and state archives, notifies the applicant to appear at the offices of this institution, to obtain more information on the property value he/she has shown interest to privatize and to receive the authorization for the payment of the purchase.
